Information on notification forms, fees and updated merger process guidelines published
The Australian Competition and Consumer Commission (ACCC) has released key resources for the new merger control regime:

Timeline
The merger control regime launches 1 January 2026. Voluntary notifications begin 1 July 2025.
Legislative Framework
The Competition and Consumer (Notification of Acquisitions) Determination 2025 was registered 30 June 2025, establishing notification thresholds, forms, and applicable fees.
Available Forms
Four downloadable forms are now accessible:
- Pre-notification engagement request form
- Short notification form
- Long notification form
- Public benefit application form
Form selection guidance: The short form suits straightforward acquisitions unlikely to raise competition concerns. The long form applies to acquisitions with greater complexity or competition risks.
Fee Information
Small business entities (aggregated turnover under AUD $10 million) may qualify for fee exemptions under the legislative instrument.
Updated Guidelines
The interim merger process guidelines address stakeholder feedback and include sections on remedies, foreign investment proposals, and confidential information handling.
