New FAQs available about letters issued under section 189 and informal public reviews

The ACCC has published an updated version of the frequently asked questions (FAQs) about merger reform. The document now addresses three new topics:

  • Section 189 Letters: Whether the ACCC can issue letters with effect under section 189 of the Competition and Consumer Act 2010 (Cth) for acquisitions of land interests or competing bid scenarios

  • Acquisitions Register Alerts: Whether subscribers can receive notifications when new entries are posted to the ACCC's Acquisitions Register

  • Informal Public Reviews: Whether the ACCC will initiate a new informal public review if it determines during September-December 2025 that it cannot pre-assess an acquisition
