New FAQs available on waiver application form, statutory exemptions and agreements for leases
The ACCC has published an updated version of the frequently asked questions (FAQs) about merger reform document. It now includes information about:
- The notification waiver application form
- The interaction of the control exemption and the exemption focused on Chapter 6 entities
- Agreements for lease
- The exemption for acquisitions of legal or further equitable interests in land after an initial equitable interest was previously notified to the ACCC
- The calculation of revenue of a connected entity that was acquired partway through the relevant 12-month period
- The accumulated acquired shares or assets revenue tests in the context of serial acquisitions
- Requests for an informal merger review after October 2025
- How to check if an application for a Tribunal review of an ACCC decision or determination has been made
These FAQs may continue to be amended from time to time to reflect the experience during the transition period. The information reflects the ACCC's views at the time of publication, but they are intended to be indicative only and may change over time.
