New FAQs available about the acquisitions portal, informal review requests and waivers
The ACCC has released an updated FAQ document addressing merger reform inquiries.
Key Updates
- Acquisitions Portal: Guidance on accessing and utilizing the online portal for merger notifications
- Informal Reviews: Timeline considerations for submitting simple informal review or pre-assessment requests through the end of 2025
- Waiver Eligibility: Clarification on waiver applications in three scenarios:
- Mergers incomplete within 12 months of receiving a section 189 Competition and Consumer Act letter
- Notified acquisitions not implemented within 12 months of approval
- Acquirers participating in competitive bid processes
- Acquisition Types: Information identifying which acquisitions qualify as suitable waiver candidates rather than requiring formal notification
