Updated merger process guidelines and FAQs now available
This update covers two main areas:
Updates to Process Guidelines
The ACCC has published updates to its interim merger process guidelines and quick guide for business to reflect recent legislative developments and process refinements during the transition period.
Key changes address:
- The new online acquisitions portal
- Pre-notification engagement process
- Multi-jurisdictional mergers
- Confidentiality processes
- Preparing supporting submissions for remedy offers and standard divesture terms
The notification waivers chapter has been temporarily removed from the guidelines. Standalone interim guidance on notification waivers was published on 1 December 2025.
The ACCC plans further updates in 2026 as legislative changes are finalized and experience with the regime evolves.
Frequently Asked Questions (FAQs)
The merger reform FAQs document has been updated to include information about:
- Deferral of certain notification requirements to 1 April 2026
- Continuation of existing revenue attribution tests through 1 April 2026
- Application of merger control rules to customer contracts for works or services
The FAQs may be amended periodically and reflect the ACCC's views at publication time.
