Updated FAQs about notification waiver applications and confidential information

Dear MergerLoop,

The ACCC's frequently asked questions (FAQs) about merger reform document has been updated. There is new and updated information about:

  • the types of acquisitions that are suitable for a notification waiver application
  • what to expect after you submit a notification waiver application
  • what is working well in notification waiver applications we have received to date
  • including and identifying confidential information in notifications or notification waiver applications.

These FAQs may continue to be amended from time to time to reflect the experience during the transition period and start of the new mandatory regime on 1 January 2026. The information reflects the ACCC's views at the time of publication, but they are intended to be indicative only and may change over time.
