Updated FAQs for the new merger regime available

Dear MergerLoop,

The ACCC's frequently asked questions (FAQs) about merger reform document has been updated. There is new and updated information about:

  • if a new licence granted by a government or regulatory body is an 'acquisition' for the purposes of the new merger control regime
  • information that can help support a notification waiver application
  • how to provide responses to the notification waiver application form and the merger notification form. This includes making a supplementary submission
  • acquisitions of discrete assets and the serial acquisitions provisions.

These FAQs may continue to be amended from time to time to reflect the experience during the transition period and start of the new mandatory regime on 1 January 2026. The information reflects the ACCC's views at the time of publication, but they are intended to be indicative only and may change over time.
